I. DEFINITIONS FOR THE PURPOSE OF THIS AGREEMENT

 

1.  VENDOR – Capitol Festival d.o.o., Šubićeva 69, Zagreb 10 000, Hrvatska, EU, OIB: 92103164597, ID Nbr.: HR92103164597

2.  „www.capitolfestival.hr“ - site owned by the vendor

3.  CUSTOMER- any person(s) or company who after reviewing and selecting products inputs ​​his/her registration data and orders the product

4.  USERS OF “www.capitolfestival.hr”- any person(s) or company who is on the site "capitolfestival.hr" for the purpose of purchasing products advertised on the site or obtaining information about a particular product

5.  USING “www.capitolfestival.hr” – accessing “www.capitolfestival.hr” for the obtaining of information or the purpose of purchasing products

6.  ONLINE PURCHASE OR THE WEB STORE – exercising the purchase of a product through “www.capitolfestival.hr”

7.  PRODUCTS - all online offers of art (prints, paintings, sculpture) which are featured on "capitolfestival.hr", which can be purchased through the web shop

 

 

II. GENERAL TERMS

 

1.     These Terms and Conditions of online purchases regulate the relationship between users of “www.capitolfestival.hr,” the Purchaser and the Vendor, in relation to the conditions and methods of ordering products, product prices, payment methods, warranty, complaints and returns, shipping, confidentiality of personal data and other issues related to the use of "www.capitolfestival.hr" and online purchases.

2.     Product Purchase Agreement between the Purchaser and the Vendor go into affect the moment of order purchase.

3.     Through "www.capitolfestival.hr" it is possible to make a purchase on Croatian territory, the European Union and other countries.

4.     By using "www.capitolfestival.hr" it is considered that the user is familiar with the General Conditions and that they accept. Vendor takes no responsibility for issues that could possibly arise because the user of "www.capitolfestival.hr" did not read the General Terms and Conditions.

5.     The Purchaser must be an adult and legally competent person(s). The contract in behalf of a minor and legally incompetent person must include his/her legal representatives and/or guardians, engaging in a contract may be concluded only with the consent of their legal guardian or custodian. To act contrary to this provision Vendor bears no responsibility.

6.     Users of “www.capitolfestival.hr" are required to provide accurate, current and complete personal information when filling out the registration form. A practice contrary to this authorizes the vendor to refuse such user access or realization of all or part of the services offered by "www.capitolfestival.hr"

7.     Vendor is entitled, without prior notice, to change the contents: the range of products, prices of these, other data related to the web shop as well as all other content of "www.capitolfestival.hr" Users of  “www.capitolfestival.hr" are bound on every visit to the website to review the contents it. Contrary to treatment relieves the Vendor of any liability.

8.     Vendor shall be relieved of all responsibility for any damage that might occur on devices that allow access to "www.capitolfestival.hr" and the data stored on the same device when using the "www.capitolfestival.hr," if it is caused due to the illegal actions of third parties, computer viruses, etc., and other cases for which the Vendor is not responsible. Also, the Vendor is relieved of any responsibility in the event of circumstances that prevent the use of "www.capitolfestival.hr"

 

 

III. WEB SHOP

 

1.     Online purchasing can be achieved only if the customer enters accurate, current and complete personal information. The customer is entitled to choose the option to be informed of new products, products in action, etc. (newsletter).

2.     Products that are available are advertised on "www.capitolfestival.hr", each product contains information on product specifications, price, shipping cost as well as other information.

3.     Selection of the desired product is made by storing it in the "basket" by clicking on the link "add to cart" Before adding to cart, it is necessary to select the possible options for ordering, in the case of prints it is - Option A - choice of unframed print - Option B - or choice of delivery framed prints. It is then possible to continue to browse and buy other products, and the selected product is stored in the shopping cart. When the buyer wants to conclude the purchase you need to click on the link "shopping cart" on the top right of the page. If the buyer makes a purchase of a product, and in the meantime, it has been sold, the Vendor is to contact the customer to agree on further action (reimbursement rates, the purchase of another product or delivery of products of the same type when the Vendor obtains it from his suppliers).

4.     In the "basket" are all products the customer chose to purchase along with the price of the product and the total price (tax included). It is necessary to choose the country of delivery by clicking on the "Select Country" after which it will be displayed along with the cost of delivery and total cost of the order, "TOTAL" ( tax included). If the buyer wants to conclude the purchase he/she selects the link "Checkout", and the system continues to automatically leads to make a payment via PayPal accounts where they will enter the required information for payment and delivery . In addition to purchasing through PayPal it  is possible to directly contact Capitol Festival D.O.O. :

IV. PRICING

 

1.     All product prices are retail. Product prices and delivery rates are in Euros for all markets outside of Croatia, and Kuna descriptive only for customers from Croatia. All prices expressed in euros contain the corresponding value-added tax, while buyers from the Croatian all accurately described.

2.     The Vendor is authorized to change prices without notice. Also, the Vendor shall be entitled without notice at any time to determine the discount, daily or weekly actions, actions for a specific product, product group and / or for all products.

3.     Regardless of the previous points of the Terms and Conditions, all ordered goods will be delivered at prices that were valid when making offers.

 

 

V. PAYMENT

 

1.Payments can be made through:

a. Cash and all major credit and debit cards, Maestro and electron cards at the office, "Capitol Festival" Zagreb, Šubićeva 69, by prior arrangement and agreement on the phone : +3851 / 463 7191

b. Cash and all major credit and debit , Maestro and electron cards at delivery to your home or business address in the wider area of the City of Zagreb

c. Postal payment prior to shipping to your home or business address

d. General, postal or bank transfer to the account "Capitol Festival" Privredna banka Zagreb , No. IBAN : HR0923400091110144018

 

2. Payment shall be deemed completed at the time of issued receipt of the authorization from PayPal, upon receipt of amounts expected to account Capitol Festival D.O.O., delivering the expected amount by postal or courier company, or a cash payment in the office of Capitol Festival or to a representative prior to delivery

 

 

VII. DELIVERY

 

1.     Products that have been paid in accordance with the submitted offer will be delivered to you within a maximum of 4 working days after payment is confirmed or received on Croatian territory. For buyers from all over the world expedited shipping methods will be arranged (road transport, train, ship, plane), and accordingly made and shipped. Shipping must be made within 3 days of confirmed or received payment from the customer. In case you purchased the product and the Vendor is unable to deliver within the specified period, they shall notify the Customer to agree on a new delivery deadline. In this case the buyer has the right to terminate the agreement.

2.     Delivery is carried out by Vendor (through his employees) or by hiring renowned shipping (courier) services

3.     Upon arrival of the shipment, the customer shall inspect the delivered product. In  case of visible damage, the customer has the right to refuse the products and request a new, undamaged product.

4.     In cases where the product that is delivered to customers is other than the one you bought, he/she is entitled to the delivery of ordered products, if this is not possible,  he/she is entitled to a full refund of the price paid for the product, delivery rates and reimbursement of product return. Customer is required to return wrong product delivered

5.     At the time of delivery, the customer receives all documents accompanying the product, account, and a confirm receipt of the item that he/she is required to sign. By signing the receipt of the consignment is considered to be a product taken no visible external damage.

6.     Delivery prices are highlighted on "www.capitolfestival.hr" including tax. Vendor's delivery rates are formed by product weight and type.

 

VIII. TERMINATION OF CONTRACT AND REFUNDS

 

1.     Customer has the right, without showing cause, to terminate the Purchase Agreement within seven business days from the date of delivery, by written notice of termination of the contract, which is required to be delivered to the Vendor at the address of the same.

2.     In the case of the previous point, the customer is obliged to return the product supplied to the Vendor at his own expense, to the address of the Vendor.

3.     Customer is not entitled to terminate the agreement in the cases provided for in Article 49. Laws Consumer Protection.

4.     Customer is entitled to return the product, payed for by the Vendor if:

a.             Wrong product(s) are delivered

b.             Damaged product(s) are delivered

5.  The buyer is obliged to, in all cases of returned products, return the original packaging,

complete with all parts and documentation.

 

 

IX. PERSONAL DATA PROTECTION

 

1.     Vendor collects personal information of customers only to the extent necessary for the fulfillment of obligations, information about new and fantastic products and the delivery of promotional materials, improving relationships with customers, and to verify other information necessary for online shopping.

2.     Vendor is committed to protecting the personal information of customers in accordance with the Law on Personal Data Protection and agrees that personal data will not in any way be given to third parties without the consent of the Buyer (except for data that is necessary for the delivery of purchased products). This is exempt in cases in which the Vendor is placed with a valid order of the authorized government body, in accordance with law, to  allow access to personal information of customers.

3.     The buyer has the right to request an update, correction or modification of inaccurate personal data.

 

 

X. OTHER TERMS

 

1.     Vendor entitles customers to use all services "www.capitolfestival.hr" only for personal, non-commercial purposes. Changing of  the contents of "www.capitolfestival.hr" in any of its form, is prohibited, as well as copying, public performance, etc. The use of content of "www.capitolfestival.hr" on other websites is prohibited.

2.     Vendor reserves the right to grant the rights to publish any materials, parts on "www.capitolfestival.hr" to third parties only in the case of contract governing the rights and obligations of the Vendor and the third party who is publishing the information.

3.     When purchasing any product that is the subject of copyright or intellectual property rights, Vendor does not give any additional rights to use and publish, unless given the right or permission of the manufacturer / distributor of the product.

4.     In the case of www.capitolfestival.hr providing relevant links with the ability to visit other websites, such websites are not the property of the Vendor and these Terms and Conditions when such web sites do not apply in respect of the Vendor and Purchaser. Vendor and the website does not control and assumes no responsibility for any of them or their content. Visiting these sites is entirely at your own risk the Vendor bears no responsibility.

5.     Although Vendor invests effort to publish accurate product information, it is possible that information about a particular product is not updated or accurate, in which case the Vendor will notify Purchaser who submitted the order after which the buyer has the right to remain in the orders or modify. Photos of the products are only illustrative, because each image is displayed on a monitor, tablet, smart phone etc. with different resolutions and other characteristics of the advertised product.
